A driver, as defined by the U.S. Department of Transportation (DOT), is a person who operates a commercial motor vehicle (CMV). In order to legally operate many categories of commercial motor vehicles, the driver must have a commercial driver's license (CDL). There are several classes of CDL with increasingly stringent requirements as vehicles become larger or affect more people.

The definition of driver found in the Department of Transportation's Federal Motor Carrier Safety Regulations is limited to those persons who operate commercial motor vehicles (CMV). A commercial motor vehicle is one that is self-propelled or towed and used on a highway or in interstate commerce and meets the additional criteria enumerated in the federal statute. Examples of commercial motor vehicles include passenger buses, tractor trailers, tanker vehicles, flatbeds, livestock carriers, some taxi services, and hot shot package delivery services. Because of the safety sensitive nature of their jobs, drivers are subject to the DOT's drug and alcohol testing rules.
